Seminar for judges and magistrates on intellectual property and creative industries in the digital era
The ‘Seminar for judges and magistrates from the Mercosur countries and Chile on intellectual property (IP) and creative industries in the digital era: challenges and solutions in the light of recent cases in Latin America and the European Union’ is being organised in collaboration with the Ministry of Industry, Energy and Mining of Uruguay through the National Directorate of Industrial Property (DNPI).
In an era marked by the rapid evolution of digital technologies, the protection of intellectual property rights poses significant challenges to legal systems worldwide. Recognising the need for collaboration and the exchange of knowledge, the seminar aims to foster dialogue among judges and magistrates from the Mercosur countries, Chile, and the European Union.
The objectives of the seminar are multifaceted. Firstly, it seeks to facilitate the exchange of best practices and insights between legal experts from the different regions, with a view to harmonising the adjudication of intellectual property cases. Secondly, the seminar hopes to promote collaboration among the different judicial authorities to improve the effectiveness of the legal mechanisms in the fight against trade mark infringements.
The seminar will delve into various relevant topics through structured modules, starting with an overview of intellectual property in the digital age to explore, for example, the emerging challenges related to NFTs, the Metaverse and artificial intelligence, before going on to discuss the evolving role of judges in safeguarding intellectual property rights.
Subsequent modules will address the resolution of intellectual property disputes, including the assessment of infringement and the impact of international treaties on national laws. Case-law analyses from the perspectives of both international/EU and Mercosur countries will provide valuable insights into recent jurisprudence, guiding participants in navigating complex intellectual property issues.
The seminar will be followed by a working group session on 10 April, organised in the framework of the AL-INVEST Verde IPR judges’ network. The purpose of the working group is to compile a compendium of IP jurisprudence from the Mercosur countries and Chile as part of their commitment to advancing legal harmonisation and jurisprudential development.
By fostering dialogue, sharing expertise and analysing recent cases, the seminar strives to equip judges and magistrates with the necessary tools to address the complexities of intellectual property protection in the digital age, to strengthen legal frameworks and foster innovation and creativity.
