Trade Mark Examiners from Latin America Train in 3D Trade Marks under the EUIPO Umbrella

In an effort to foster cooperation and harmonisation in the field of intellectual property (IP), trade mark examiners from MERCOSUR and Chile came together to participate in specialised training on three-dimensional trade marks.

The event, ‘Training on the Practice of Trade Mark Examination: 3D Trade Marks’, was held online and was attended by prominent representatives of the IP offices of Argentina, Brazil, Chile, Paraguay, and Uruguay.

This workshop focused on the law and examination practices of the European Union Intellectual Property Office (EUIPO) in relation to three-dimensional trade marks. The main objective of the event was to provide examiners with a comprehensive understanding of the EUIPO’s processes, and the criteria it applies, when examining three-dimensional trade marks. The workshop’s aim was to encourage a consistent approach in examination practices.

Participants had the opportunity to acquire key knowledge in several areas, including:

• Understanding the legal framework governing three-dimensional trade marks in the European Union, providing examiners with an in-depth insight into the relevant regulations.
• The examination criteria the EUIPO applies when examining three-dimensional trade mark applications, allowing participants to evaluate applications effectively.
• Identifying common challenges and pitfalls that examiners may encounter when examining 3D marks.
• The best practices and strategies that can be applied when examining three-dimensional marks, promoting a consistent and efficient approach.
• The relationship between three-dimensional trade marks and other IP rights, including designs, copyright, and patents, contributing to a more holistic understanding of the subject.

This event was a unique opportunity for trade mark examiners in the region to gain valuable knowledge and meet other experts. Collaboration, and harmonising examination practices, is essential in the field of IP. This workshop contributed significantly to this goal.
