Convergence of trade mark examination practices: review of the ASEAN common guidelines on substantive trade mark examination

Running from July to December 2026, this activity supports the continued convergence of trade mark examination practices across ASEAN Member States by reviewing and updating the ASEAN Common Guidelines for the Substantive Examination of Trademarks. Building on earlier efforts from SCOPE IPR predecessor programmes, the initiative seeks to ensure that the Guidelines remain aligned with recent legal developments, evolving case-law and international best practices. It aims to enhance quality, consistency and transparency of examination procedures across the region.

Aligned with Strategic Measure 2 of the ASEAN IPR Action Plan 2026-2030, the activity contributes to the harmonisation of regulatory frameworks and the strengthening of regional cooperation. Senior trade mark officials from ASEAN IP Offices will convene to review and update the Guidelines. This revision will include benchmarking against EUIPO guidelines and integrating relevant national and international developments. If feasible, the updated Guidelines may also be transformed into a digital, user-friendly and searchable format. This resource would be made available through the ASEAN IP Portal and national IP office websites, further improving accessibility and practical use for examiners and stakeholders.
