Support for legislative alignment with the EU acquis in Ukraine: comparative legal analysis and drafting of amendments and regulations on geographical indications
Target Country: Ukraine
IPR area: Geographical indications
This activity will support the Ukrainian authorities in aligning national Geographical indications (GI) legislation with the EU acquis. It will:
- Review and compare the law and relevant implementing regulations with the EU GI acquis, including the latest EU GI reform package;
Identify legal, procedural and institutional gaps and draft amendments to the primary law and/or new implementing regulations on GIs; - Organise technical meetings with Ukrainian National Office for Intellectual Property and Innovations (UANIPIO), the Ministry of Economy, and other stakeholders to validate findings and ensure coherent alignment;
- Conduct a stakeholder workshop to present proposed amendments, gather feedback and ensure broad consultation;
- Prepare guidance materials and training content for UANIPIO and the GI community to support the implementation of the amended framework;
- Support UANIPIO and other competent authorities in developing internal procedures and staff capacities required to apply the updated rules effectively.
In addition, the activity may consider the assessment of relevant international instruments beyond the EU acquis, in particular the World Intellectual Property Organization (WIPO) Geneva Act of the Lisbon Agreement, for which cooperation with WIPO could be required to ensure full technical alignment. Depending on policy priorities and relevance for the legislative approximation process, the scope may also include considerations arising from the WIPO Treaty on Genetic Resources and Associated Traditional Knowledge.
The activity will be implemented in close coordination with UANIPIO, the Ministry of Economy and other national stakeholders involved in the legislative process.
