Support for legislative approximation with the EU-Armenia CEPA agreement in copyright: comparative legal analysis and drafting of amendments and regulations on copyright and related rights

In line with EU–Armenia Comprehensive and Enhanced Partnership Agreement (CEPA) commitments and EU best practice, this activity will:

  • Prepare a comparative legal analysis of the proposed new draft Law of the Republic of Armenia on Copyright and Related Rights and related secondary instruments against the EU copyright acquis (with emphasis on Directive 2019/790 and other directly relevant directives); 
  • Identify legal and practical gaps, including in collective rights management, exceptions and limitations (education, libraries, research), digital uses and online distribution, orphan works and relevant enforcement mechanisms;
  • Draft targeted amendments to primary law and draft secondary legislation (regulations/by-laws) as appropriate to reduce divergences and improve legal clarity and predictability;
  • Provide short technical notes on implementation options and resource implications for Armenian Intellectual Property Office (AIPO) and line ministries;
  • Organise technical meetings and a workshop to present findings and gather stakeholder feedback as required;
  • Translate executive summaries or key documents into Armenian and English as required.

Experts (EU and international) with experience in implementing or advising on EU copyright Directives will prepare the comparative study and the draft legal texts. The activity will be implemented in close coordination with AIPO and relevant stakeholders.

Furthermore, this activity will ensure alignment with the ongoing harmonisation efforts in the EU copyright system, particularly under the recently launched Copyright Knowledge Center, managed by the EUIPO.
