Support for legislative alignment with the EU acquis in Ukraine: finalisation and implementation of amendments to the regulation on trade marks

In line with Ukraine’s commitments under the EU accession process and the Deep and Comprehensive Free Trade Area, this activity will support the Ukrainian National Office for Intellectual Property and Innovations (UANIPIO) and relevant authorities in the comparative legal analysis and approximation of Ukrainian trade mark law to the EU acquis. It will:

  • Carry out a detailed comparative analysis of Ukrainian trade mark legislation vis-à-vis Directive (EU) 2015/2436 and Regulation (EU) 2017/1001;
  • Assess the degree of conformity and identify gaps or inconsistencies between the Ukrainian and EU frameworks;
  • Propose draft amendments to the Law on protection of rights to marks for goods and services and related by-laws, as required;
  • Develop supporting regulatory texts, implementation guidance, and explanatory notes to accompany legislative updates;
  • Facilitate technical meetings and at least one national workshop with stakeholders to validate findings, discuss proposed amendments, and agree on the way forward;
  • Provide translation and expert support as needed to ensure the coherence and usability of comparative legal materials.

The activity will be implemented in close coordination with UANIPIO, the Ministry of Economy of Ukraine, and relevant national stakeholders.
